Terms of Service

HexGen (the "Service") is operated by the HexGen team ("we", "us"). It lets you generate images and videos with third-party AI models from a single studio. By creating an account or using the Service, you agree to these Terms.

You must be at least 18 years old, or the age of majority in your jurisdiction if higher, to use HexGen. By using the Service you confirm that you meet this requirement.

You are responsible for everything that happens under your account, including keeping your sign-in credentials safe. Tell us right away if you suspect unauthorized access. You may not share your account or use someone else's.

HexGen is pay-as-you-go. You purchase HGcoins and spend them on generations. The current rate is 1 USD = 1,000 HGcoins. Each model has its own per-generation price displayed in the studio before you run it.

• HGcoins do not expire.
• HGcoins are not redeemable for cash and cannot be transferred between accounts.
• Top-ups are processed through our payment provider. Local taxes may apply and will be shown at checkout when required.

If a generation fails because of an error on our side or the model provider's side, the HGcoins charged for that run are refunded to your balance automatically. Beyond this, all purchases of HGcoins are final and non-refundable, except where required by applicable consumer-protection law.

You agree not to use HexGen to create, upload, request, or distribute:

• Child sexual abuse material (CSAM), or any sexual content depicting minors or minor-coded characters.
• Non-consensual sexual content or sexual content depicting an identifiable real person without their explicit consent.
• Content that impersonates a real person in a way designed to deceive (for example, fabricated statements or actions attributed to them).
• Material that infringes intellectual property, trade secrets, or publicity rights.
• Content that promotes terrorism, violent extremism, self-harm, or targeted harassment.
• Material designed to defraud, deceive, or run malware, credential phishing, or other unlawful schemes.

You also agree not to reverse-engineer the Service, attempt to bypass usage limits or content filters, or use HexGen to compete with us by re-selling its core API access to third parties without a written agreement.

You own the inputs you upload (references, prompts) and the outputs you generate, to the extent ownership is possible under applicable law for AI-generated content. Commercial use of your outputs is included.

You grant us a limited, worldwide, royalty-free license to store, transmit, process, and display your inputs and outputs solely as needed to operate and improve the Service (for example, to render generations, surface them in your gallery, and route them to model providers you select). This license ends when you delete the content or your account, subject to short technical retention windows described in our Privacy Policy.

You are responsible for what you generate. Make sure your inputs and outputs do not violate the law or anyone else's rights.

HexGen runs generations on models hosted by third parties (such as Google, OpenAI, ByteDance, and Kuaishou). When you select a model, your prompt and any reference media are sent to that provider so they can produce the requested output. Each provider has its own terms and content policies, and we may change which providers we work with at any time.

Model behavior, quality, availability, and pricing are determined by the provider and may change without notice. We do our best to surface that on the model card, but cannot guarantee any specific output.

We work hard to keep HexGen running, but the Service is provided on a best-effort basis. We do not promise specific uptime, performance, or that any feature will remain available indefinitely.

You can close your account at any time from the settings page. We may suspend or terminate accounts that violate these Terms, abuse the Service, or create risk for other users, our providers, or us. When that happens we will tell you the reason where we can, and any unused HGcoins associated with the closed account are forfeited unless the law requires otherwise.

The Service is provided "as is" and "as available", without warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Generative AI can produce inaccurate, biased, or unexpected results. Do not rely on outputs for medical, legal, financial, or safety-critical decisions.

To the maximum extent permitted by law, neither HexGen nor its team will be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising from your use of the Service. Our total liability for any claim relating to the Service is capped at the amount you paid us in the twelve months before the event that gave rise to the claim.

We may update these Terms from time to time. When we make material changes we will update the "Last updated" date above and, where appropriate, let you know inside the app or by email. Continuing to use the Service after the changes take effect means you accept the updated Terms.
